Judge decides if Trump’s payment case should be dismissed

A Manhattan judge will determine if Donald Trump’s criminal hush money conviction should be dismissed based on the Supreme Court’s recent presidential immunity ruling. The decision comes following Trump’s conviction on 34 counts of falsifying business records related to payments made to adult film actress Stormy Daniels before the 2016 presidential election.

The former president could face up to four years behind bars for these charges. However, the landscape shifted when the Supreme Court issued a 6-3 decision in July, establishing that former presidents have complete immunity from prosecution for actions taken while performing their official duties.
The high court’s ruling left the interpretation of what qualifies as an “official act” to lower courts. Manhattan Supreme Court Justice Juan Merchan postponed the sentencing for more than four months, pushing it past the election period.

Should the conviction remain in place, Trump’s sentencing is set for November 26, approximately two months prior to his potential inauguration.
